Joint Civil Society Statement on the Migration Ministry bill

Working for an organisation registered in the “NGO Registry” of the Ministry of Migration and Asylum becomes a punishable offence with the proposed changes to Articles 24 and 25 of the Migration Code.

After five years of constant recommendations from the European Commission, the Council of Europe and the UN to put an end to arbitrary restrictions on the work of civil society organisations supporting refugees and migrants, the Ministry continues to target the organisations deemed inconvenient solely for carrying out their work.

The mere membership of an organisation registered in the NGO Registry elevates misdemeanours such as facilitation of illegal stay, or refusal to hand a travel document, to felonies punishable by up to ten years’ imprisonment and fines of tens of thousands of euros. It is thus considered an aggravating circumstance sufficient to reclassify the offence as a felony, in an affront to fundamental principles of criminal policy and legislation. Mere criminal prosecution suffices for removal of the organisation from the Registry.

These provisions are intended to intimidate civil society. They are introduced only a few months after the Minister of Migration and Asylum made threats against the legal representatives of people who arrived in Crete during the unlawful three-month asylum ban and were protected from deportation by interim measures of the European Court of Human Rights. These attacks were immediately condemned by international and national institutions, yet the competent Minister refuses to retract them.

For the undersigned organisations, this attempt is unjust, unlawful, and unreasonable. We call for the immediate withdrawal of these provisions.

Κοινή Δήλωση Οργανώσεων για το Νομοσχέδιο του Υπουργείου Μετανάστευσης

 

Με τις προτεινόμενες αλλαγές στα άρθρα 24 και 25 του Κώδικα Μετανάστευσης, το να είσαι εργαζόμενος/η σε οργάνωση εγγεγραμμένη στο «Μητρώο ΜΚΟ» του Υπουργείου Μετανάστευσης και Ασύλου καθίσταται ποινικά κολάσιμο.

Μετά από πέντε χρόνια συνεχών συστάσεων της Ευρωπαϊκής Ένωσης, του Συμβουλίου της Ευρώπης και του ΟΗΕ για την άρση των αυθαίρετων περιορισμών στη λειτουργία των οργανώσεων της κοινωνίας των πολιτών που υποστηρίζουν πρόσφυγες/προσφύγισσες και μετανάστες/ριες, το Υπουργείο συνεχίζει να στοχοποιεί τις οργανώσεις που θεωρεί ενοχλητικές για τον μόνο λόγο ότι κάνουν τη δουλειά τους.

Μόνη η ιδιότητα του μέλους οργάνωσης εγγεγραμμένης στο Μητρώο ΜΚΟ αναβαθμίζει πλημμελήματα όπως η διευκόλυνση παράνομης παραμονής ή η άρνηση παράδοσης ταξιδιωτικού εγγράφου σε κακουργήματα με δεκαετή κάθειρξη και πρόστιμο δεκάδων χιλιάδων ευρώ. Θεωρείται δηλαδή επιβαρυντική περίσταση ικανή να αναβαθμίσει το αδίκημα σε κακούργημα η δηλωθείσα και εγκεκριμένη άσκηση του δικαιώματος του συνεταιρίζεσθαι, σε πείσμα θεμελιωδών αρχών αντεγκληματικής πολιτικής και ποινικής νομοθέτησης. Αρκεί, δε, η άσκηση ποινικής δίωξης για να διαγραφεί η οργάνωση από το Μητρώο.

Οι διατάξεις αυτές έχουν ως στόχο τον εκφοβισμό μας. Εισάγονται λίγους μόλις μήνες μετά τις απειλές του Υπουργού Μετανάστευσης και Ασύλου κατά των νομικών εκπροσώπων των ανθρώπων που έφτασαν στην Κρήτη κατά τη διάρκεια της παράνομης τρίμηνης αναστολής ασύλου και προστατεύτηκαν από απέλαση με ασφαλιστικά μέτρα του Ευρωπαϊκού Δικαστηρίου Δικαιωμάτων του Ανθρώπου, τις οποίες καταδίκασαν άμεσα οι διεθνείς και εθνικοί θεσμοί αλλά αρνείται να ανακαλέσει ο αρμόδιος Υπουργός.  

Για τις υπογράφουσες οργανώσεις η προσπάθεια αυτή είναι άδικη, παράνομη και παράλογη. Ζητάμε την άμεση απόσυρση των διατάξεων.
